Terms of Service

1. Who we are and what these terms cover

These terms are an agreement between you and MediaAtlas d.o.o., Kajuhova 11, 8290 Sevnica, Slovenia, registration no. 6942733000 ("MediaAtlas", "we"). They cover: (a) this website, mediaatlas.si ("the Site"); (b) our online services, today the decision models API (https://decision.mediaatlas.si) and Master Blaster (https://masterblaster.mediaatlas.si) ("the Online Services"); and (c) our project services, such as AI model training, AI Act review and private deployments ("Project Services"), which are also governed by the written offer or order we agree with you.

Each Online Service has a page with details of its own (retention of data, limits, how a result is made). Where it differs from these terms it wins for that service. For a Project Service the signed offer or order wins over these terms. By using the Site or an Online Service, or by placing an order, you accept these terms.

2. Using the Site

You may read the Site, link to it and quote it with attribution. Search engines and AI assistants may read it as robots.txt and llms.txt allow. Do not copy it wholesale, remove notices, break or overload it, try to reach what is not public, or use it unlawfully.

3. Keys, orders and who may buy

The Online Services have no user accounts: the API key is your account. When you pay, the key is shown once on the page after the payment. It is not sent by e-mail and we cannot show it again; if you lose it write to info@mediaatlas.si and we will issue a new one. Keep it secret. You are responsible for everything done with it, including keys that you make for your own agents and programs.

The services are meant for businesses and professionals. If you buy as a consumer, the mandatory consumer rights of your country stay as they are (see section 6).

4. Prices, VAT, payment and plans

Prices are in euro and shown without VAT. Slovenian VAT of 22 % is added at checkout, or other VAT treatment where the law requires it. Payment is taken by Stripe; we never see your card number. Receipts and invoices come from Stripe.

• Monthly plans renew every month until you cancel. You can cancel, change the plan and see invoices in the billing portal (the Online Service explains how). A cancellation takes effect at the end of the paid month. We do not refund a month that has started, except as in sections 6 and 9.
• A plan has a fixed quota (for example input tokens or tracks a month). Unused quota does not carry over. When the quota is used up the service stops answering (HTTP 429 or 402); there is no automatic extra charge.
• Single purchases (for example one master) are paid in advance.
• Project Services are priced in the offer and invoiced as it says.
• We may change prices for the future. For a running subscription we tell you at least 30 days before the change takes effect and you may cancel before then.

5. Your content and what we do with it

You keep all rights to what you send us (text, images, audio, data) and to what the services return. You promise that you have the right to send it. We use it only to provide the service you asked for, keep it only as long as the page of that service says, do not use it to train models, and do not look at it except to fix a fault you report or stop abuse.

If what you send contains personal data and you decide why it is processed, you are the controller and we are your processor. Write to info@mediaatlas.si and we will sign a data processing agreement. Do not send special categories of personal data unless you have a lawful basis for it.

6. Consumers

If you are a consumer, nothing in these terms takes away rights that the law gives you and that cannot be waived. You may withdraw from a contract made online within 14 days without giving a reason. When you ask us to start at once, a single digital product (for example a finished master) that has been delivered cannot be withdrawn from, and for a subscription you pay for the part of the service used until you withdraw. To withdraw, write to info@mediaatlas.si. Where a master or other result clearly did not work, we make it again or refund it.

7. Results from models

The services use machine learning models. Their results are statistical and can be wrong, incomplete or worse than your original; they are not advice. You are responsible for how you use a result and for checking it before you rely on it. Do not let a decision model make a decision alone that has legal or similarly significant effects on a person without human oversight, and if you put a result into a product regulated by the EU AI Act you are the one who has to meet the duties of a deployer or provider.

8. Acceptable use

Do not use the services to break the law, to harm or deceive people, to attack or probe our systems, to get around limits (quotas, rates, concurrency), to resell raw access to the API as such without our agreement, or for practices that Article 5 of the EU AI Act prohibits. You may build your own products and automations on top of the services. We may refuse or stop a request, revoke a key or block an address if the services are misused, and for serious cases without notice.

9. Availability, support and changes to the services

The Online Services are provided "as is", without a promised uptime or a particular result, unless a written agreement (for example a Business or Private plan) says otherwise. We may improve, change or stop a feature. If we stop a paid service altogether we refund the unused part of the period you paid for. Support is by e-mail at info@mediaatlas.si in working days; the plan may state a response time.

10. Intellectual property

The Site, its text, design, software and our models' packaging belong to MediaAtlas or its licensors. We use open models and components under their own licences (for example Apache 2.0); those licences apply to them. Results belong to you as section 5 says. Where Master Blaster adds a credit line or a signed proof of mastering to a file, the Master Blaster page explains it.

11. Liability

Nothing here limits liability that cannot be limited by law, in particular for intent or gross negligence, or for death or personal injury, and nothing limits the mandatory rights of consumers. Otherwise we are not liable for indirect or consequential damage or lost profit. Towards businesses our total liability for all claims connected with an Online Service is limited to the fees you paid for it in the 12 months before the event; for a Project Service, to the price of that order.

12. Suspension and ending

You may stop using a service at any time and cancel a plan as in section 4. We may suspend or end your access if you break these terms, if a payment fails and is not put right, or if the law requires it. Parts that by their nature should survive (payment, liability, intellectual property, governing law) survive.

13. Privacy

How we handle personal data is in our Privacy Policy and on the page of each Online Service. Stripe processes payment data as an independent controller under its own privacy policy.

14. Third-party links and e-mail

The Site links to other sites and platforms that we do not control and are not responsible for. If you write to us, we use your message only to reply and do not share it except as the law requires.

15. Changes to these terms

We may change these terms. The date at the top is the date of the latest version. For a change that makes things worse for a paying customer we tell you by e-mail or on the Site at least 30 days before it applies; if you do not agree you may cancel before then, and continued use after that means you accept.

16. Law, disputes and language

Slovenian law applies, together with EU law that applies directly. Disputes are decided by the courts competent for our registered seat in Slovenia; this does not take away the right of a consumer to the mandatory protection and the courts of their country of residence. We try to settle complaints first: write to info@mediaatlas.si. A consumer may also turn to the Market Inspectorate of the Republic of Slovenia. These terms exist in English and Slovenian; if they differ, the Slovenian text prevails. If a provision is invalid, the rest stays in force, and the invalid part is replaced by the nearest valid one.

17. Our commitments

• We do not train models on your content.
• We do not sell or rent your data.
• We say plainly what a service does and does not do, including its limits.
